Terms of Service

1. What these terms cover

EstimateKit is business software for HVAC contractors: estimates, customers, jobs, invoicing and payment tracking, at estimatekit.com. By creating an account or using the service you agree to these terms. If you are using EstimateKit for a company, you confirm you can accept these terms on its behalf.

2. Your account

• You must give accurate details and keep your login secure. You are responsible for what happens under your account, including what your team members do.
• Owners and admins can invite team members; everyone in an organization shares that organization's data.
• You must be able to form a binding contract and use the service for a lawful business purpose.

3. Free trial and subscription

• New accounts get a 14-day free trial. No card is required and nothing is charged during the trial.
• After the trial, continued use requires a paid subscription, billed monthly at the price shown on the pricing page at the time you subscribe. One subscription covers your whole organization up to the stated team limit; there are no per-user fees.
• Payments are processed by Stripe. Prices are in the currency shown at checkout and exclude applicable taxes unless stated otherwise.
• If a payment fails, we will retry and let you know. Access may be limited until payment succeeds.
• We may change prices with at least 30 days' notice by email. Changes apply from your next billing period.

4. Cancelling

There is no contract term. You can cancel at any time from your account settings; your subscription ends at the close of the current billing period and you are not charged again. We do not give refunds for partial months. After cancelling, your account stays available in read-only form for a period so you can export your data, after which it may be deleted.

5. Your data

• Your customers, estimates, jobs and invoices are yours. We do not sell them and we use them only to run the service for you.
• You can export your data at any time from settings.
• You are responsible for the accuracy of what you put into EstimateKit and for the estimates, invoices and communications you send to your customers through it.
• How we handle personal information is described in our Privacy Policy.

6. Acceptable use

Don't use EstimateKit to send spam or unlawful communications, to store content you have no right to, to interfere with the service or other customers, or to attempt to access accounts or data that are not yours. We can suspend or close accounts that do.

7. Our service

• We work to keep EstimateKit available and improving, but we provide it "as is". We don't promise it will be uninterrupted or error-free, and we may change or add features over time.
• The free calculators, templates and guides on the site are for general information. Check the figures against your own costs and local requirements before you rely on them.
• EstimateKit is a tool for producing your documents; it is not accounting, tax or legal advice.

8. Limits on our liability

To the fullest extent the law allows, EstimateKit is not liable for indirect or consequential losses, lost profits, or lost data arising from your use of the service, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

9. Changes to these terms

We may update these terms as the product changes. For material changes we will email account owners before they take effect. Continuing to use EstimateKit after that means you accept the updated terms.

10. Governing law

These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. Disputes will be handled in the courts of British Columbia, unless local law gives you the right to bring a claim where you live.
